SECTION 301 — New Tariffs Affecting Mexico, Canada & Other Countries

The White House directed USTR to impose new Section 301 tariffs related to forced-labor import enforcement across numerous trading partners. Most importantly for AMG clients, the action specifies a 10% tariff rate on goods of Mexico and Canada, among several other economies, subject to exemptions identified in the action.
AMG Recommendation: Importers should closely monitor USTR and CBP implementation guidance, including effective dates, HTS modifications, product exemptions, and how the new Section 301 duties will apply to upcoming entries.

Section 122 Temporary 10% Import Surcharge
Published: July 23, 2026
The temporary 10% import surcharge imposed under Section 122 of the Trade Act of 1974 expires July 24, 2026.
Unless extended by Congress or otherwise modified, the additional 10% duty will no longer apply after the expiration of the temporary measure.
Importers should review upcoming shipments to ensure the correct tariff treatment is applied.

Canada: Additional 50% U.S. Duties Announced

The U.S. announced an additional 50% duty on certain Canadian products listed in the proclamation’s annex. The duties are scheduled to take effect on August 19, 2026.
AMG Recommendation: Review affected HTS classifications and upcoming Canadian shipments before entry.
ALUMINUM
New Section 232 Aluminum Investment Incentive Announced

The White House issued a proclamation establishing an incentive program under Section 232 to encourage investment in U.S. primary aluminum production. Companies that build, expand, or modernize aluminum smelters in the United States may qualify for reduced tariff rates on certain aluminum imports if they meet program requirements approved by the Department of Commerce.
AMG Recommendation: Importers of aluminum products should monitor future guidance from the Department of Commerce and CBP, as implementation details may affect import compliance and duty obligations.
USMCA: U.S.–Mexico Negotiations Continue

The U.S. and Mexico are continuing bilateral negotiations related to the USMCA Joint Review, including discussions involving steel and aluminum, automobiles, supply-chain security and other trade issues.
AMG Recommendation: Importers engaged in U.S.–Mexico trade should continue monitoring negotiations for potential changes affecting cross-border requirements.
